Terms of Use

Welcome to Vivian ("the Application"), an artificial intelligence tool that translates Spanish text and speech into Mexican Sign Language (LSM) through an animated 3D avatar. The Application is operated by the Vivian Solutions Co. team ("we", "our", "us").

By accessing or using Vivian, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Application.

1. Service Description

Vivian is an AI-assisted translation tool that: - Converts written Spanish text into LSM sign sequences. - Transcribes speech to text using voice recognition and translates it to LSM. - Presents signs through an animated 3D avatar. - Allows users to submit feedback on translation quality.

2. Eligibility and Minimum Age

To use Vivian, you must be at least 13 years old. If you are under 18, you represent that you have the consent of your parent or legal guardian. We reserve the right to request age verification at any time.

3. User Accounts

  • Registration: You may create an account using email and password, or sign in with Google or Apple.
  • Guest Mode: You may use limited functionality without creating an account. In this case, a device identifier is assigned to you.
  • Responsibility: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Permitted Use and Prohibited Conduct

Permitted Uses - Translation of Spanish text or speech to LSM for educational, communicative, or research purposes. - Submitting feedback to improve service quality.

Prohibited Conduct The following are strictly prohibited: - Using the Application for illegal or fraudulent activities. - Attempting to decompile, reverse engineer, or extract the source code, AI models, animations, or glossary of the Application. - Intentionally overloading servers or abusing the API. - Impersonating another person or entity. - Using bots, scrapers, or other automated methods to access the service without prior authorization.

5. EXCLUSION FROM SENSITIVE USE CASES

Vivian is NOT suitable for and is NOT designed to be used in the following contexts:

  • Health and medicine: medical consultations, diagnoses, health emergencies.
  • Psychology and mental health: therapy sessions, crisis interventions.
  • Legal contexts: judicial proceedings, legal statements, certified interpretation.
  • Emergencies: situations where an incorrect translation could endanger a person's life or safety.
  • Any situation that requires certified professional interpretation.

Vivian's translations are generated by artificial intelligence and may contain errors, inaccuracies, or be incomplete. They should never substitute a professional LSM interpreter.

6. License to User Content

By using Vivian, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to: - Store, analyze, and use the translations you generate (input text and resulting sign sequences) for the purpose of training, improving, and optimizing Vivian's artificial intelligence model. - Use the feedback (ratings, likes, reports) you submit to improve translation quality and user experience. - Aggregate and anonymize usage data for statistical analysis and UX improvement.

This license persists even if you delete your account, with respect to data that has already been processed and incorporated into the training model in anonymized form.

7. Intellectual Property

All content in Vivian — including but not limited to: the 3D avatar, sign animations, LSM glossary, source code, AI models, interface design, and brand — is the exclusive property of the Vivian Solutions Co. team and is protected by applicable intellectual property laws.

No intellectual property rights are transferred to the user through use of the Application.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Application is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied.
  • We do not guarantee the accuracy, completeness, or suitability of the generated translations.
  • We are not liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use or inability to use the Application.
  • We are not liable for decisions made based on translations provided by Vivian.
  • We are not liable for service interruptions, data loss, or errors in the Application.

Use of Vivian is at your own risk. By using the Application, you acknowledge and accept that translations are AI-generated and may not accurately reflect Mexican Sign Language.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Vivian Solutions Co. team, its directors, employees, and collaborators from any claim, damage, loss, liability, cost, or expense (including attorney fees) arising from: - Your use or misuse of the Application. - Your violation of these Terms. - Your violation of third-party rights.

10. Beta Program

If you participate in Vivian's Beta program: - You acknowledge that the Application is under active development and may contain bugs. - Continuous availability or specific features are not guaranteed. - Your access may be revoked at any time without prior notice. - We reserve the right to modify or discontinue features at any time.

11. Service Availability

We do not guarantee that the Application will be available without interruption. We may suspend, modify, or discontinue the service (in whole or in part) at any time, with or without notice, without liability to you.

12. Termination

We reserve the right to suspend or delete your account and access to the Application, at our sole discretion, at any time and for any reason, including but not limited to breach of these Terms. You may also delete your account at any time from the Application settings.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon publication in the Application. Continued use of Vivian after publication of changes constitutes your acceptance of the modified Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, waiving any other jurisdiction that may apply.
